Is There a Time Limit on When I Can File a Lawsuit?

Yes. For civil personal injury lawsuits there is a time limit, known as a “statute of limitations”. Each state has different limits. In New York, an individual has three years to initiate a lawsuit regarding personal injury, damage to personal property, and product liability. For medical malpractice cases, the statute of limitations is two and a half years. For libel and slander cases in New York, a lawsuit must be filed within one year.
